Credential Analysis

  • The signer presents a valid, government-issued photo ID (e.g., driver’s license, passport).

  • The RON platform uses specialized software to analyze the ID’s authenticity.

  • The software checks for security features, tampering, and ensures the document is not expired.

  • Third-party identity verification services are typically used for this step.

Knowledge-Based Authentication (KBA)

The signer must answer a series of personal, dynamic questions generated from public records.

These are typically five multiple-choice questions based on the signer’s financial, credit, or historical records.

Examples might include previous addresses, vehicle registrations, or loan details.

The signer must answer at least four out of five questions correctly within a set time (usually two minutes).

If the signer fails, they may get a second attempt. A failure on the second try typically results in denial of the notarization.

In Pennsylvania, notaries can perform remote online notarizations (RON) by following specific requirements set by the state. Here’s the process for a notary to conduct remote services:

1. Commission & Authorization

  • The notary must hold an active Pennsylvania notary commission.

  • They must notify the Pennsylvania Department of State of their intent to perform remote notarizations.

  • The notary must identify the RON provider platform they intend to use, which must meet state regulations for identity verification, recording, and storage.

2. Use Approved Technology Platform

  • The platform must provide secure, real-time audio-visual communication.

  • It must meet compliance standards, including secure electronic recordkeeping and tamper-evident technology.

3. Identity Verification

  • The notary must verify the identity of the signer using a multi-step process, typically including both:

    • Credential Analysis: The platform checks the validity of a government-issued ID using third-party verification.

    • Knowledge-Based Authentication (KBA): The signer answers personal questions to verify their identity.

4. Perform the Notarization

  • The notary and signer communicate through live video and audio.

  • The signer electronically signs the document.

  • The notary applies their electronic signature and seal using the platform.

  • The notarial act is recorded, and a video of the session is securely stored for at least 10 years.

5. Recordkeeping

  • The notary must maintain an electronic journal that logs all remote notarial acts.

  • This journal should include details like the date, time, type of document, method of ID verification, and a video recording of the notarization.

6. Compliance with PA Law

  • The notary must follow Pennsylvania's Revised Uniform Law on Notarial Acts (RULONA) and regulations.

  • Ensure all notarial certificates indicate that the act was performed using remote communication.
